   インターネットが爆発的に普及するなか、ネット上での規制についても関心が高まっている。本書はこういったインターネットなどのサイバースペースにおける法規制のあり方をテーマとしながらも、「インターネットは、著作権を無視した違法コピーや無修正の違法ポルノが横行し、システム破壊を狙うハッカーたちが手ぐすねをひく無法・無秩序空間」とし、「規制を強化しろ」と画一的に結論づける既存の書物とは一線を画している。

   本書では法律や条令、行政指導といったものだけではなく、人のふるまいに影響を及ぼすすべてのことを「規制」と定義づけており、それらはインターネットの規制を考えるうえで重要だとしている。また本書の規制に対する関心は、目先の規制をどうやってかわすかや現状の規制にどう収まるかというような今日や明日の話にはなく、もっと根底の深い部分にある。我々がもっている規制の総体について注目し、さらにその総体がインターネットの導入によってどう変わり、今後インターネットが大きく変化していくなかで総体がどう変化を遂げるかという点について大きな関心を寄せている。「ショッピングサイトを立ち上げるときに気をつけておかなければならない法律的な知識が知りたい」といった手軽なあんちょこ的な内容を期待する人よりは、広く深くインターネットの規制について考えたい人におすすめしたい。（近藤大介）

There’s a common belief that cyberspace cannot be regulated—that it is, in its very essence, immune from the government’s (or anyone else’s) control.Code argues that this belief is wrong. It is not in the nature of cyberspace to be unregulable; cyberspace has no “nature.” It only has code—the software and hardware that make cyberspace what it is. That code can create a place of freedom—as the original architecture of the Net did—or a place of exquisitely oppressive control.If we miss this point, then we will miss how cyberspace is changing. Under the influence of commerce, cyberpsace is becoming a highly regulable space, where our behavior is much more tightly controlled than in real space.But that’s not inevitable either. We can—we must—choose what kind of cyberspace we want and what freedoms we will guarantee. These choices are all about architecture: about what kind of code will govern cyberspace, and who will control it. In this realm, code is the most significant form of law, and it is up to lawyers, policymakers, and especially citizens to decide what values that code embodies.
